Terms of Sale

ARTICLE 1 — SELLER IDENTIFICATION

The online store accessible at sifibeauvois.com (hereinafter the “Website”) is operated by SIFI BEAUVOIS SAS, a French Simplified Joint-Stock Company (SAS) with a share capital of €50,000, whose registered office is located at 7 rue des Bernardines, 25300 Pontarlier, France. The company is registered with the Trade and Companies Register of Besançon under SIREN: 999 627 961. Intra-Community VAT number: FR79999627961. Contact email address: contact@sifibeauvois.com.

 

ARTICLE 2 — SCOPE, ELIGIBILITY & ACCEPTANCE

2.1 Scope

These Terms of Sale (hereinafter the “Terms”) govern all purchases of SIFI BEAUVOIS products made through the Website, whether for immediately available products, pre-order products, or products subject to production lead times. They apply without restriction to all sales models offered on the Website, including immediate purchase, pre-order with deposit, and pre-order with full advance payment.

2.2 Consumer Purchases Only

The Website is intended exclusively for purchases by natural persons acting as consumers (hereinafter the “Customer”), meaning any natural person who acts for purposes outside their trade, business, craft, or profession, in accordance with applicable European and French consumer protection law.

By placing an order, the Customer represents and warrants that they are an end consumer purchasing for personal use or as a gift. Any purchase for the purpose of resale, distribution, or any other commercial activity is strictly prohibited. Persons acting in a professional capacity or on behalf of third parties for resale purposes must contact SIFI BEAUVOIS at contact@sifibeauvois.com for information regarding the Brand’s authorized selective distribution network.

2.3 Eligibility

Only natural persons who have reached the age of legal majority in their jurisdiction, who have the legal capacity to enter into binding contracts, and who use a shipping address in a country served by the Website may place an order. If the Customer has not reached the age of legal majority, a parent or legal guardian must place the order on their behalf and accept these Terms.

2.4 Acceptance

By placing an order on the Website, the Customer acknowledges having read, understood, and accepted these Terms in full without reservation, together with the Privacy Policy available on the Website. These Terms prevail over any other general or specific conditions not expressly approved by SIFI BEAUVOIS.

SIFI BEAUVOIS reserves the right to amend these Terms at any time. The Terms applicable to any given order are those in force on the Website at the time the order is placed. Any amendment made after an order has been placed will not affect that order.

 

ARTICLE 3 — PRODUCTS

3.1 Product Description

The products offered for sale on the Website are SIFI BEAUVOIS timepieces and related accessories (hereinafter the “Products”). Each Product is presented with a description of its essential characteristics, including technical specifications, materials, dimensions, and available references.

SIFI BEAUVOIS makes every effort to ensure that product descriptions, photographs, and specifications displayed on the Website are accurate. However, minor variations may occur between images displayed and the actual Product due to photography, screen rendering, or production tolerances inherent to high-end handcrafted watchmaking. Such minor variations shall not in themselves constitute a defect or lack of conformity.

3.2 Product Modifications

SIFI BEAUVOIS reserves the right to make minor technical, aesthetic, or packaging modifications to its Products at any time, provided that such modifications do not materially affect the overall quality, functionality, or perceived value of the Products. This applies in particular to Products offered on a pre-order basis, where the final delivered Product may incorporate refinements made during the production process. Such modifications shall not entitle the Customer to cancel the order or claim any compensation, provided that the essential characteristics and value of the Product are preserved.

3.3 Availability

SIFI BEAUVOIS timepieces are produced in limited quantities within consolidated manufacturing batches. Products are offered subject to availability. In the event that a Product becomes unavailable after an order has been placed, SIFI BEAUVOIS shall promptly inform the Customer and offer either a full refund of all amounts paid or, where possible, a comparable alternative subject to the Customer’s acceptance.

 

ARTICLE 4 — ORDERING PROCESS

4.1 Order Placement

To place an order, the Customer selects the desired Product(s), adds them to the shopping cart, provides the required billing and shipping information, selects the delivery method, reviews the order summary (including total price, applicable taxes, and shipping costs), accepts these Terms by checking the corresponding box, and confirms the order by clicking the “Confirm and Pay” button (or equivalent).

The placement of an order on the Website constitutes a binding offer by the Customer to purchase the selected Product(s) subject to these Terms. The Customer must carefully review and verify all order details on the summary page before confirming the order.

4.2 Acknowledgement of Receipt

Following submission of the order and processing of the payment (whether full or partial, as applicable), the Customer will receive an automatic acknowledgement of receipt by email, confirming that the order has been registered and summarizing its details. This acknowledgement of receipt does not constitute acceptance of the order by SIFI BEAUVOIS.

Upon receiving the acknowledgement of receipt, the Customer should verify that it accurately reflects their order. If any information is incorrect, the Customer must contact SIFI BEAUVOIS promptly at contact@sifibeauvois.com.

4.3 Order Confirmation

Following standard payment verification, identity checks, fraud prevention controls, and stock or allocation confirmation, SIFI BEAUVOIS will send the Customer a written Order Confirmation by email (or, where applicable, a combined Order and Shipping Confirmation). This Order Confirmation constitutes SIFI BEAUVOIS’ acceptance of the order and the formation of the binding sales contract between the Parties.

SIFI BEAUVOIS reserves the right to refuse or cancel any order, at any stage prior to Order Confirmation, in the event of a pricing error, suspected fraudulent activity, failure of payment verification, incomplete or incorrect information, suspected purchase for resale or commercial purposes, or any other legitimate reason. In such cases, any payment already received will be refunded in full without undue delay.

4.4 Quantity Limits

SIFI BEAUVOIS reserves the right to limit the number of Products that may be purchased per Customer per order or per reference, in order to preserve the availability of its limited-production timepieces. Any order exceeding such limits may be reduced or refused at SIFI BEAUVOIS’ sole discretion.

 

ARTICLE 5 — SALES MODELS & PAYMENT TERMS

SIFI BEAUVOIS may offer Products under one or more of the following sales models on the Website. The applicable sales model is indicated on each Product page at the time of purchase.

5.1 Immediate Purchase

When a Product is indicated as immediately available, the full purchase price (including applicable taxes and shipping costs) is due at the time the order is placed. The Product is dispatched following Order Confirmation and upon receipt of full payment.

5.2 Pre-Order with Deposit

When a Product is offered on a pre-order basis with deposit, the order process is as follows:

– A deposit of fifty percent (50%) of the total Product price is due at the time the order is placed. This deposit secures the Customer’s allocation within the applicable production batch.

– The remaining balance of fifty percent (50%) is due prior to shipment and will be invoiced by SIFI BEAUVOIS when the Product is ready for dispatch. The Product will not be shipped until full payment has been received.

Legal qualification: In accordance with Article L.214-1 of the French Consumer Code, the deposit paid under this sales model constitutes an acompte (advance payment), not arrhes (earnest money). This distinction matters because, under French law, sums paid in advance by a consumer are presumed to be arrhes unless the contract expressly states otherwise. As such, the deposit constitutes a firm and definitive commitment by both Parties, subject to the right of withdrawal provided for in Article 9 herein, Article 5.5 (Minimum Batch Volume), and any applicable mandatory legal provisions.

5.3 Pre-Order with Full Advance Payment

When a Product is offered on a pre-order basis with full advance payment, the full purchase price is due at the time the order is placed. The Product is dispatched upon completion of the applicable production batch, in accordance with the estimated lead time indicated on the Product page and in the Order Confirmation.

5.4 Estimated Production Lead Times

Products offered on a pre-order basis are manufactured within consolidated production batches. The estimated production lead time is indicated on the Product page and confirmed in the Order Confirmation email. Such lead times are indicative and may vary depending on manufacturing constraints, quality control requirements, or other operational considerations. SIFI BEAUVOIS shall keep the Customer informed of production progress and will notify the Customer of any material delay.

By placing a pre-order, the Customer expressly acknowledges and accepts the estimated production lead time. In the event that SIFI BEAUVOIS is unable to deliver the Product within a reasonable time following the estimated lead time, the Customer may cancel the order by written notice and obtain a full refund of all amounts paid.

5.5 Minimum Batch Volume

Where production is organized in consolidated manufacturing batches, SIFI BEAUVOIS may make the launch of a production batch conditional upon the achievement of a minimum order volume. If such minimum order volume is not reached within the period indicated on the relevant Product page or in the Order Confirmation, SIFI BEAUVOIS reserves the right not to proceed with the relevant production batch. In such event, SIFI BEAUVOIS shall notify the Customer and refund all amounts paid in full without undue delay. No additional compensation shall be due by either Party, without prejudice to any mandatory rights of the Customer under applicable consumer law.

5.6 Retention of Title

Ownership of the Product remains with SIFI BEAUVOIS until full payment of all amounts due has been received. Risk transfers to the Customer upon physical delivery, as set out in Article 8.4.

 

ARTICLE 6 — PRICES

6.1 Displayed Prices

All prices displayed on the Website are expressed in euros (€) and include all applicable taxes, unless otherwise stated. Shipping costs, customs duties, and any import taxes applicable to the Customer’s country are not included in the displayed price and will be indicated separately during the checkout process.

SIFI BEAUVOIS reserves the right to modify its prices at any time. The price applicable to an order is the price displayed on the Website at the time the order is placed.

6.2 Price Errors

SIFI BEAUVOIS makes every effort to ensure that the prices displayed on the Website are accurate. In the event of a manifest pricing error, SIFI BEAUVOIS shall contact the Customer as soon as possible to inform them of the error. The Customer may then choose to confirm the order at the corrected price or to cancel the order and obtain a full refund. If SIFI BEAUVOIS is unable to reach the Customer, the order will be cancelled and any payment received will be refunded in full.

 

ARTICLE 7 — PAYMENT

7.1 Payment Methods

Accepted payment methods are indicated on the Website and may include credit card (Visa, Mastercard, American Express), bank transfer, and other secure payment solutions available at checkout. All payment transactions are processed through a certified and secure payment service provider. SIFI BEAUVOIS does not store or have access to the Customer’s full payment card details.

7.2 Payment for Pre-Orders

For pre-orders with deposit, the initial deposit is charged at the time the order is placed. The balance invoice will be sent by email when the Product is ready for dispatch, and must be settled within seven (7) calendar days of receipt. Failure to pay the balance within this period may result in cancellation of the order at SIFI BEAUVOIS’ discretion, in which case the deposit will remain due as an advance payment already committed, without prejudice to the Customer’s mandatory rights under applicable consumer law.

For pre-orders with full advance payment, the full amount is charged at the time the order is placed.

7.3 Bank Transfers

Orders paid by bank transfer must be credited to SIFI BEAUVOIS’ account within seven (7) calendar days of the order being placed. If payment is not received within this period, the order may be cancelled. SIFI BEAUVOIS does not charge any processing fee for bank transfers; however, any fees charged by the Customer’s bank remain the Customer’s responsibility.

7.4 Payment Security

Online payments are secured using industry-standard encryption and authentication protocols. In the event of suspected unauthorized use of a payment method, SIFI BEAUVOIS reserves the right to suspend or cancel the order pending verification.

 

ARTICLE 8 — DELIVERY

8.1 Delivery Area

SIFI BEAUVOIS delivers to the countries listed on the Website at the time of order. Certain destinations may be excluded due to regulatory, logistical, or customs-related constraints.

8.2 Delivery Methods

All SIFI BEAUVOIS timepieces are shipped via insured express courier with tracking and signature upon delivery required. SIFI BEAUVOIS may also offer personal collection at designated locations, where indicated on the Website. SIFI BEAUVOIS reserves the right to require proof of identity upon delivery or collection.

8.3 Delivery Lead Times

For immediately available Products, estimated delivery lead times are communicated during checkout and in the Order Confirmation email. Such lead times are indicative and may vary depending on the destination, customs clearance procedures, and carrier operations.

For pre-order Products, the delivery lead time corresponds to the estimated production lead time indicated on the Product page plus the shipping time to the Customer’s address.

If delivery is not completed within thirty (30) calendar days of the confirmed dispatch date (or such other period as expressly agreed), the Customer may cancel the order by written notice and obtain a full refund of all amounts paid, in accordance with applicable law.

8.4 Risk Transfer

Risk of loss or damage to the Product transfers to the Customer upon physical receipt of the Product by the Customer or a designated third party (other than the carrier). If the Product is visibly damaged upon delivery, the Customer should note the damage on the delivery slip and contact SIFI BEAUVOIS within forty-eight (48) hours.

8.5 Customs, Duties & Import Taxes

For deliveries outside the European Union, the Customer is solely responsible for all customs duties, import taxes, and any other charges levied by local authorities. SIFI BEAUVOIS has no control over these charges and cannot predict their amount. The Customer is advised to contact local customs authorities for further information prior to placing an order.

 

ARTICLE 9 — RIGHT OF WITHDRAWAL

9.1 Withdrawal Period

In accordance with applicable European and French consumer protection legislation, the Customer has the right to withdraw from the purchase without giving any reason within fourteen (14) calendar days from the date of physical receipt of the Product, regardless of when payment was made. For pre-orders, the withdrawal period begins upon receipt of the Product, not upon payment of the deposit or full price.

To exercise the right of withdrawal, the Customer must notify SIFI BEAUVOIS of their decision by sending a clear, unambiguous statement (e.g., by email to contact@sifibeauvois.com) before the expiry of the withdrawal period. The Customer may use the model withdrawal form annexed to these Terms, but it is not obligatory.

9.2 Exceptions to the Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to Products that have been made to the Customer’s specifications or clearly personalized (e.g., engraved Products, bespoke dial configurations, or any other customization carried out at the Customer’s request). The non-returnable nature of personalized Products will be clearly indicated on the Product page and during the ordering process.

9.3 Return Conditions

The Customer must return the Product to SIFI BEAUVOIS without undue delay and in any event within fourteen (14) calendar days of communicating the withdrawal decision. The Product must be returned in its original condition, unworn (other than the reasonable handling necessary to establish its nature, characteristics, and functioning, as would be permitted in a physical store), complete with all original packaging, accessories, documentation, warranty card, and protective elements.

Given the value and nature of the Products, SIFI BEAUVOIS strongly recommends that the return be made via insured courier with tracking. The costs of returning the Product are borne by the Customer. SIFI BEAUVOIS shall not be held responsible for any loss, theft, or damage occurring during return shipment.

9.4 Quality Inspection

All returned Products are subject to a quality inspection by SIFI BEAUVOIS upon receipt. SIFI BEAUVOIS reserves the right to refuse any return, or to reduce the applicable refund amount, if the Product shows signs of wear, use, alteration, or damage beyond what is necessary to establish its nature and characteristics, or if the Product is returned without its complete original packaging, accessories, and documentation.

9.5 Refund

Subject to the quality inspection described above, SIFI BEAUVOIS will refund the Customer the total amount paid (including the initial delivery charges, if applicable) within fourteen (14) calendar days of receiving the returned Product or proof of return shipment, whichever occurs first. The refund will be made using the same payment method used for the initial transaction, unless the Customer expressly agrees otherwise.

For pre-orders with deposit, in the event of withdrawal exercised after receipt of the Product, both the deposit and the balance (if already paid) will be refunded in accordance with the above conditions.

9.6 Gift Purchases

If a Product was purchased as a gift, only the original purchaser is entitled to exercise the right of withdrawal and to receive a refund. The recipient of a gift may contact SIFI BEAUVOIS at contact@sifibeauvois.com to discuss available options.

 

ARTICLE 10 — WARRANTY

10.1 Commercial Warranty

Each SIFI BEAUVOIS timepiece is covered by the SIFI BEAUVOIS International Warranty (or Limited Warranty for the United States and Canada), the terms of which are set out in the official SIFI BEAUVOIS Terms of Warranty delivered with the Product. This commercial warranty provides a base coverage of two (2) years from the date of purchase, extendable to five (5) years upon registration on sifibeauvois.com. The scope, conditions, and exclusions of the commercial warranty are defined exclusively in the Terms of Warranty.

10.2 Legal Guarantee of Conformity

In addition to the commercial warranty, the Customer benefits from the legal guarantee of conformity (garantie légale de conformité) as provided for under Articles L.217-1 et seq. of the French Consumer Code. Under this legal guarantee, the Customer may request repair or replacement of a Product that does not conform to the contract within two (2) years from delivery of the Product. The Customer is not required to prove the existence of the defect during this period.

Where repair or replacement is impossible, or cannot be implemented within a reasonable time or without significant inconvenience to the Customer, the Customer may obtain a price reduction or a full refund, in accordance with applicable law.

10.3 Legal Guarantee Against Hidden Defects

The Customer also benefits from the legal guarantee against hidden defects (garantie légale des vices cachés) as provided for under Articles 1641 et seq. of the French Civil Code. Under this guarantee, the Customer may choose to return the Product and obtain a full refund, or to retain the Product and obtain a partial refund, if the Product is affected by a hidden defect that renders it unfit for its intended use or significantly diminishes its value. The action must be brought within two (2) years of the discovery of the defect.

10.4 Relationship Between Warranties

The commercial warranty provided by SIFI BEAUVOIS is in addition to, and does not replace, affect, or limit the Customer’s rights under the legal guarantees of conformity and hidden defects. The Customer may assert any of these guarantees independently, in accordance with applicable law.

 

ARTICLE 11 — AFTER-SALES SERVICE

After-sales servicing and repairs are available for all SIFI BEAUVOIS timepieces and are handled in accordance with the SIFI BEAUVOIS Terms of Warranty.

Service lead times are communicated following inspection and diagnosis of the timepiece and remain indicative. Any service or repair work performed by SIFI BEAUVOIS or by an authorized service partner is covered by a service warranty of twelve (12) months from the date of return of the serviced timepiece, limited to the operations performed and the parts replaced during the intervention.

 

ARTICLE 12 — LIMITATION OF LIABILITY

Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any mandatory statutory consumer rights.

Subject to the foregoing, SIFI BEAUVOIS shall not be held liable for any damage resulting from the improper use of a Product, failure to follow the care and maintenance recommendations provided in the user manual, or any modification or intervention performed by an unauthorized third party.

To the maximum extent permitted by applicable law, SIFI BEAUVOIS’ total liability in connection with any order shall not exceed one hundred percent (100%) of the price of the Product(s) in question. SIFI BEAUVOIS shall not be liable for any indirect, incidental, special, or consequential damages, to the fullest extent permitted by law.

SIFI BEAUVOIS shall not be liable for temporary unavailability of the Website due to maintenance, technical issues, or events beyond its reasonable control.

ARTICLE 13 — INTELLECTUAL PROPERTY

All content displayed on the Website, including but not limited to trademarks, logos, photographs, texts, graphics, designs, and product descriptions, is the exclusive property of SIFI BEAUVOIS or its licensors and is protected by applicable intellectual property laws. Any reproduction, representation, modification, distribution, or exploitation of such content, in whole or in part, without the prior written consent of SIFI BEAUVOIS is strictly prohibited.

 

ARTICLE 14 — PERSONAL DATA & COOKIES

SIFI BEAUVOIS collects and processes personal data in connection with orders placed on the Website, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and applicable French data protection legislation. The Website also uses cookies and similar tracking technologies in accordance with applicable regulations.

For complete information on data processing practices, data retention, cookies, and the exercise of data protection rights, the Customer is invited to consult the Privacy Policy available on the Website.

 

ARTICLE 15 — FORCE MAJEURE

SIFI BEAUVOIS shall not be held liable for any delay or failure in the performance of its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, sanctions, embargoes, strikes, supply chain disruptions, carrier delays, or any other event constituting force majeure as defined under applicable French law.

In such circumstances, SIFI BEAUVOIS will use reasonable efforts to minimize the effects of the event and to resume performance as soon as reasonably practicable.

 

ARTICLE 16 — GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of France, without prejudice to any mandatory consumer protection provisions applicable in the country where the Customer is habitually resident. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent French courts, without prejudice to any mandatory jurisdiction rules applicable under the Customer’s local consumer protection laws.

 

ARTICLE 17 — SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

 

ARTICLE 18 — ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any specific conditions indicated on the Website at the time of order, constitute the entire agreement between SIFI BEAUVOIS and the Customer in relation to the purchase of Products through the Website. They supersede any prior agreements, arrangements, or proposals relating to the same subject matter.
